					<content:encoded><![CDATA[<p>How do I create an accessible parking space?</p>
<p>The Texas Accessibility Standards (TAS) regulates the size and placement of accessible parking spaces. The Texas Department of Licensing and Regulation (TDLR) is the state agency responsible for enforcing the TAS, which covers a wide range of accessible building components. The TAS has been certified as being equivalent to the Americans with Disabilities Act (ADA) standards, so parking spaces constructed using the TAS are also compliant with the federal ADA standards.</p>
<p>The Texas Accessibility Standards requires that:</p>
<ul>
<li>A minimum number of accessible parking spaces must be provided, consistent with the chart below. At least one out of every eight spaces, but no less than one, must be made van-accessible.</li>
<li>Accessible parking spaces must be located on the shortest accessible route of travel to an accessible entrance. If there are multiple accessible entrances, the accessible parking spaces shall be dispersed and located closest to the accessible entrances.</li>
<li>Parallel parking is discouraged unless it can be situated so that persons entering and exiting vehicles will be out of the flow of traffic.</li>
<li>Accessible parking spaces must be at least 96 inches (2440 millimeters) wide.</li>
<li>Each accessible parking space must have either an access aisle at least 60 inches (1525 millimeters) wide or a van-accessible aisle at least 96 inches (2440 millimeters) wide. Parking spaces and access aisles must be level, with a maximum allowable slope of 2% in all directions. Each accessible parking space shall be designated as a reserved space with a sign showing the symbol of accessibility. Designated van-accessible parking spaces must have an additional &#8220;Van-Accessible&#8221; sign mounted below the symbol of accessibility.</li>
<li>Signs shall be located 60 Inches (1525 millimeters) above the ground.</li>
<li>Covered parking must provide a minimum vertical clearance of 114 inches (2895 millimeters) at ntrances, exits, passenger loading zones, and along at least one vehicle access route.</li>
<li>Covered parking must provide a minimum vertical clearance of 98 inches (2490 millimeters) at all van-accessible spaces.</li>
<li>Passenger loading zones shall provide an access aisle at least 60 inches (1525 millimeters) wide and 240 inches (6100 millimeters) long parallel to the vehicle pull-up space.</li>
<li>Two parking spaces may share the same access aisle.</li>
</ul>
<p>The Department of Justice Restriping Parking Lots Technical Assistance</p>
<p>When a business restripes a parking lot, it must provide accessible parking spaces as required by the ADA Standards for Accessible Design.  In addition, businesses or privately owned facilities that provide goods or services to the public have a continuing ADA obligation to remove barriers to access in existing parking lots when it is readily achievable to do so. Because restriping is relatively inexpensive, it is readily achievable in most cases.</p>

<div id="_mcePaste">(1)  the person stands a vehicle on which are displayed license plates issued under Section 504.201 or 504.202 or a disabled parking placard in a parking space or area designated specifically for persons with disabilities by:</div>
<div id="_mcePaste">(A)  a political subdivision; or</div>
<div id="_mcePaste">(B)  a person who owns or controls private property used for parking as to which a political subdivision has provided for the application of this section under Subsection (f); and</div>
<div id="_mcePaste">(2)  the standing of the vehicle in that parking space or area is not authorized by Section 681.006, 681.007, or 681.008.</div>
<div id="_mcePaste">(b)  A person commits an offense if the person  stands a vehicle on which license plates issued under Section 504.201 or 504.202 are not displayed and a disabled parking placard is not displayed in a parking space or area designated specifically for individuals with disabilities by:</div>
<div id="_mcePaste">(1)  a political subdivision; or</div>
<div id="_mcePaste">(2)  a person who owns or controls private property used for parking as to which a political subdivision has provided for the application of this section under Subsection (f).</div>
<div id="_mcePaste">(c)  A person commits an offense if the person stands a vehicle so that the vehicle blocks an architectural improvement designed to aid persons with disabilities, including an access aisle or curb ramp.</div>
<div id="_mcePaste">(d)  A person commits an offense if the person lends a disabled parking placard issued to the person to a person who uses the placard in violation of this section.</div>
<div id="_mcePaste">(e)  In a prosecution under this section, it is presumed that the registered owner of the motor vehicle is the person who left the vehicle standing at the time and place the offense occurred.</div>
<div id="_mcePaste">(f)  A political subdivision may provide that this section applies to a parking space or area for persons with disabilities on private property that is designated in compliance with the identification requirements referred to in Section 681.009(b).</div>
<div id="_mcePaste">(g)  Except as provided by Subsections (h)-(k), an offense under this section is a misdemeanor punishable by a fine of not less than $500 or more than $750.</div>

<div id="_mcePaste">(2)  not less than 20 or more than 30 hours of community service.</div>

<div id="_mcePaste">(2)  30 hours of community service.</div>
<div id="_mcePaste">(k)  If it is shown on the trial of an offense under this section that the person has been previously convicted four times of an offense under this section, the offense is punishable by a fine of $1,250 and 50 hours of community service.</div>
<div id="_mcePaste">(l)  A person commits an offense if the person:</div>
<div id="_mcePaste">(1)  stands a vehicle on which are displayed license plates issued under Section 504.201 or a disabled parking placard in a parking space or area for which this chapter creates an exemption from payment of a fee or penalty imposed by a governmental unit;</div>
<div id="_mcePaste">(2)  does not have a disability;</div>
<div id="_mcePaste">(3)  is not transporting a person with disability; and</div>
<div id="_mcePaste">(4)  does not pay any applicable fee related to standing in the space or area imposed by a governmental unit or exceeds a limitation on the length of time for standing in the space or area.</div>

					<content:encoded><![CDATA[<p>Sec. 681.003.  PARKING PLACARD APPLICATION.  (a)  An owner of a motor vehicle regularly operated by or for the transportation of a person with a disability may apply for a disabled parking placard.</p>
<p>(b)  An application for a disabled parking placard must be:</p>
<p>(1)  on a form furnished by the department;</p>
<p>(2)  submitted to the county assessor-collector of the county in which the person with the disability resides; and</p>
<p>(3)  accompanied by a fee of $5 if the application is for a temporary placard.</p>
<p>(c)  Subject to Subsections (e) and (f), the first application must be accompanied by a notarized written statement or written prescription of a physician licensed to practice medicine in this state or a state adjacent to this state, or authorized by applicable law to practice medicine in a hospital or other health facility of the United States Department of Veterans Affairs, certifying and providing evidence acceptable to the department that the person making the application or on whose behalf the application is made is legally blind or has a mobility problem that substantially impairs the person&#8217;s ability to ambulate.  The statement or prescription must include a certification of whether the disability is temporary or permanent and information acceptable to the department to determine the type of disabled parking placard for which the applicant is eligible.  The department shall determine a person&#8217;s eligibility based on evidence provided by the applicant establishing legal blindness or mobility impairment.</p>
<p>(d)  Information concerning the name or address of a person to whom a disabled parking placard is issued or in whose behalf a disabled parking placard is issued is confidential and not subject to disclosure under Chapter 552, Government Code.</p>
<p>(e)  If a first application for a disabled parking placard under this section is made by or on behalf of a person with:</p>
<p>(1)  a mobility problem caused by a disorder of the foot, the notarized written statement or written prescription required by Subsection (c) may be issued by a person licensed to practice podiatry in this state or a state adjacent to this state; or</p>
<p>(2)  a disability caused by an impairment of vision as provided by Section 681.001(2), the notarized written statement or written prescription required by Subsection (c) may be issued by a person licensed to engage in the practice of optometry or the practice of therapeutic optometry in this state or a state adjacent to this state.</p>
